Summit project on hold in South Dakota

Summit Carbon Solutions’ carbon sequestration pipeline is officially on hold in South Dakota.  Summit filed a motion last week with the South Dakota Public Utilities Commission to suspend its permit application for the pipeline indefinitely.  The decision comes on the heels of the South Dakota Legislature passing legislation prohibiting developers from using eminent domain to acquire land, construct or operate a carbon dioxide pipeline.

South Dakota Governor Larry Rhoden signed the bill March 6th and the legislation will go into effect July 1st.

Summit has faced stiff opposition in South Dakota, and the company attempted to claim its right to the use of eminent domain when it filed more than 80 eminent domain lawsuits against South Dakota landowners about two years ago.
